However, the most impactful change came with voters-approved Amendment 3 in 2018, which declared that any expansion of gambling activities on Florida soil needs a statewide go-ahead from Floridians by voting via a state ballot.

In July, Amendment 3 could be the moment in Florida's gambling history when we got the genie back into a bottle and made it impossible for anyone to expand online sportsbooks or more gaming needs unilaterally beyond what is approved today. It was a result of growing worries about the spread of gambling and its social implications that necessitated this change. The amendment mandated that all future gambling measures, like legalized sports betting, must receive approval from Florida voters.

Seminole Tribe 2021 Compact

In May 2021, Governor Ron DeSantis inked a new exclusive sports betting compact with the Seminole Tribe of Florida to operate sports wagering within state limits for up to thirty years. This compact was important because it would have allowed the Seminole Tribe to run sports betting on their lands and online, giving them a stranglehold over much of Florida's potential sports betting market. The compact required the tribe to pay $500 million yearly for exclusive rights, helping solidify its lock on gaming in Florida.

Legal Challenges

They faced a road of litigation after the compact was signed to make government-run sports betting up and running in Florida. A federal judge invalidated the compact in November 2021, just a few weeks after Hard Rock Sportsbook went live, based on violations of both state and federal laws. That decision led to Hard Rock Sportsbook abruptly shutting down its operations and casting the state of sports betting in Florida into a new realm.

Legal challenges ensued over the compact's legality and whether it granted Seminoles exclusive rights to certain games, leading major players such as West Flagler Associates Inc. But in June 2023, the U.S. Court of Appeals for the D.C. Circuit reversed that lower court ruling, keeping sports betting alive in Florida as a possibility. That ruling allowed Hard Rock Bet to re-launch its sportsbook app as of November, initially limiting it to existing customers before opening access up statewide for all Florida bettors by December.

The State of Sports Betting in Florida Today

The lone legal sportsbook open for business in Florida is Hard Rock Bet. The fact that the Seminole compact dictates exclusivity is due to regulations bonded in the legal framework surrounding any such situation. The compact not only gives the tribe a monopoly on sports betting, but it also protects them from any competition by requiring stiff rent payments. The legal terrain is still complicated, with more regulatory obstacles ahead and controversy from a few other gambling entities that want in on the action.

Role of Political Dynamics

In addition, political dynamics have been instrumental in how Florida sports betting is currently arranged. Governor Ron DeSantis has strongly supported the Seminole Compact because he expects it to make big money for Florida. The approval of the compact was considered a political win for him, dovetailing with broader administration aims to boost the state's economy and create new jobs.
